Udaybharat Mart shall at all times strive to comply with applicable data protection and IT laws; however, the Company shall not be held liable for any act or omission by an individual (including employees, delivery agents, vendors, or third parties) acting beyond authorized company policies or instructions.

- Personal Details: Name, phone number, email address, delivery address, payment information.
- Account Data: Login credentials, order history, preferences.
- Location Data: GPS data for accurate order delivery and driver assignment.
- Device & Usage Data: IP address, browser type, device ID, and app usage statistics.
- Payment Details: Processed securely via third-party payment gateways; we do not store full card numbers.
3. Use of Information
We use the information strictly for operational, legal, and business purposes, including:
- Account management, delivery, and customer support;
- Processing payments and verifying transactions;
- Communication of updates, offers, or policies;
- Legal compliance, security monitoring, and internal audit;
- Research, analytics, and service improvement.
4. Disclosure & Sharing
While Udaybharat Mart takes reasonable care to ensure that its employees and partners maintain confidentiality and integrity of user data, the Company shall not be liable for any unauthorized access, misuse, loss, or disclosure of data caused by:
- Employee or delivery partner negligence, intentional misconduct, or violation of policy;
- Acts of third-party vendors, service providers, or technology partners outside our reasonable control;

Each employee, contractor, and third party is personally responsible for compliance with this Policy and applicable laws.
5. Limitation of Liability
5.1 To the maximum extent permitted by law, Udaybharat Mart shall not be responsible for any indirect, incidental, consequential, punitive, or special damages arising out of or relating to any unauthorized act or omission of its employees, delivery personnel, vendors, or third-party associates.
5.2 The Company's aggregate liability (if any) under this Policy shall not exceed the amount paid by the User to the Company for the specific transaction giving rise to the claim.
5.3 In case of a proven violation or breach caused by any individual associated with the Company, such person shall be solely and personally liable, and the Company reserves the right to initiate disciplinary, civil, or criminal proceedings against the erring person.
6. Internal Compliance & Employee Accountability
6.1 Every employee and delivery partner of Udaybharat Mart is bound by confidentiality agreements and data-handling protocols.
6.2 Any violation of this Privacy Policy or misuse of customer data by an employee, vendor, or delivery partner shall constitute misconduct under company policy and may lead to termination, legal action, and liability shifting fully to the concerned person.
6.3 The Company maintains internal records and audit trails to identify such misconduct and assist law enforcement where required.
6.4 Users agree that Udaybharat Mart cannot be held responsible for rogue or unauthorized actions performed by individuals in breach of company instructions or law.
7. Indemnity by Users and Partners
By using the Services, each User, employee, and partner agrees to indemnify, defend, and hold harmless Udaybharat Mart, its directors, officers, affiliates, and agents from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of:
- Misuse, unauthorized disclosure, or alteration of data by the User or any employee;
- Breach of this Policy or any applicable law by an employee or partner;
- Negligence, fraud, or misconduct by any delivery partner, service provider, or vendor.
This indemnity shall survive termination of any account or relationship.
8. Company's Good-Faith Effort
Udaybharat Mart employs best-practice safeguards — technical, organizational, and administrative — to protect data. However:
- No electronic transmission or storage is fully secure;
- The Company does not guarantee absolute security or uninterrupted protection;
- The Company's responsibility ends at maintaining reasonable and lawful safeguards under prevailing standards.
9. Force Majeure and External Breaches
The Company shall not be held liable for any data loss, breach, or unauthorized access arising due to causes beyond its control, including but not limited to:
- Hacking, malware, or cyber incidents by third parties;
- Network or system outages;
- Acts of God, natural disasters, or governmental actions;
- Vendor or telecom network failures.
10. User Responsibility
Users are responsible for:
- Protecting their login credentials, passwords, and OTPs;
- Avoiding sharing personal data on public forums or chat;
- Reporting any suspicious or unauthorized activity to the Company promptly.
Failure to do so may limit the Company's responsibility for resulting loss or damage.
11. Legal Compliance and Cooperation
Udaybharat Mart shall cooperate with law enforcement or regulators, if necessary, to investigate or prevent unlawful activities. Disclosure of user data may be made when required by law, without notice to the user, and without liability to the Company.
12. Dispute Resolution & Governing Law
Any dispute, claim, or controversy arising out of this Policy or related to misuse of information shall be governed by the laws of India.
Exclusive jurisdiction shall vest with the courts at Varanasi, Uttar Pradesh.
Users and partners expressly waive any right to dispute jurisdiction elsewhere.
13. Acknowledgment
By using Udaybharat Mart's Services:
- You acknowledge that this Policy has been read, understood, and accepted;
- You agree that Udaybharat Mart's obligations are limited to the extent set forth herein;
- You waive any claim against the Company for actions caused by employee misconduct, third-party failure, or force majeure events.
